SMS Terms & Conditions
The rules of the road for receiving text-message alerts from Ktechhq. Plain language, with the no-marketing promise and your data ownership front and center.
1. SMS from Ktechhq is for operational alerts only — no marketing, ever. 2. Your phone number and message data belong to you. We don't sell, rent, or share them with third parties for marketing. You can delete them at any time.
01The program
The Ktechhq SMS program delivers automated alerts tied to events in the Services you use with us. Example messages include:
- "Build #4821 succeeded." (CI / deployment pipeline)
- "Build #4822 failed: type error in src/api/auth.ts." (CI / deployment pipeline)
- "New comment on ticket #14 from Alex." (Project management automation)
- "Reminder: standup in 15 minutes." (Calendar automation you configured)
- "Your daily digest is ready." (Reporting automation you configured)
These are examples — the actual alerts depend on which automations you set up. You always see the source of every message in the message body itself.
02Not for marketing
No promotional content. No sales offers. No newsletters. No cross-sell of third-party products. No "we miss you" re-engagement campaigns. No upsells. No affiliate offers. No surveys for marketing purposes. SMS is reserved strictly for the operational alerts you opted in to.
If we ever decide to add an optional marketing channel, it will require a separate, explicit opt-in from you. We will never convert your operational opt-in into a marketing opt-in automatically.
03Opt-in & consent
You opt in to receive SMS alerts through one of the following actions — each of which constitutes your express written consent under the Telephone Consumer Protection Act (TCPA):
- Entering your phone number in the in-product notification settings and toggling SMS alerts on for a specific automation.
- Replying YES to a confirmation text we send when you initiate an SMS-enabled automation.
When you opt in, you confirm that:
- You are the account holder, or you have the account holder's permission to use the phone number.
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You understand that consent is not a condition of purchasing any goods or services from Ktechhq.
You can opt out at any time. Opting out of one automation does not automatically opt you out of others — though opting out of all SMS is one click away in your account settings.
04Message frequency
Message frequency varies by the automations you enable and how often the events occur. As a general guide:
- Low-frequency automations (e.g. daily digests, weekly reports) — typically 1–4 messages per month.
- Medium-frequency automations (e.g. CI build alerts, scheduled reminders) — typically 5–30 messages per month.
- High-frequency automations (e.g. real-time monitoring) — could be 1–10 messages per day, capped at whatever limits you set in your account.
You can set quiet hours, daily limits, and per-automation caps. If a configured limit is exceeded, we'll bundle the alerts into a digest instead of sending each one individually.
05Costs & rates
Message and data rates may apply for any SMS we send, depending on your mobile carrier and plan. Ktechhq does not charge you a fee for the SMS service itself, but your carrier's standard messaging rates still apply.
Check with your carrier for details on your specific plan. International rates may apply if you're traveling outside the U.S. when a message is delivered.
06Supported carriers
SMS delivery is supported on all major U.S. carriers, including but not limited to:
- AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Cricket, Metro by T-Mobile, Tracfone, Boost Mobile, Google Fi, and other T-Mobile/MVNOs.
- Most regional and pre-paid carriers operating on the major networks above.
Carriers are not liable for delayed or undelivered messages. Delivery is on a best-effort basis and depends on factors outside our control (network coverage, device state, etc.).
07Opting out
You can stop receiving SMS at any time, by any of these methods:
- Reply STOP to any message we send. You'll receive a one-time confirmation and no further messages.
- Update your notification settings in your Ktechhq account.
- Email info@ktechhq.com with your phone number and the word "unsubscribe."
Note: STOP opts you out of all Ktechhq SMS, not just the specific automation. To re-enable, opt in again from your account settings.
08Help
Reply HELP to any message for help, or contact info@ktechhq.com. We respond to support requests during business hours (U.S. Eastern Time, Mon–Fri) and aim for same-day replies.
09Your data & privacy
When you opt in to SMS, we collect and store:
- Your phone number — to deliver the alerts you requested.
- The content of each message we send you — for delivery confirmation, debugging, and audit.
- Delivery status (delivered, failed, queued) — provided by your carrier, used to retry failed messages and improve reliability.
- Basic opt-in / opt-out events with timestamps — required by law to prove consent.
We do not collect, and do not want, any other personal information via SMS. We will never ask you for a password, payment info, or sensitive data over text. If you receive any such message claiming to be from us, treat it as fraudulent and report it.
Our full data practices — including how we share with the SMS delivery partner — are described in our Privacy Policy. For healthcare clients, opt-in capture and revocation (verbal and written) is described in our Communications Opt-In Policy.
10Data ownership
Ktechhq will not sell, rent, lease, loan, trade, or otherwise commercially exploit your phone number or the content of your messages. We share phone numbers only with the SMS delivery partner strictly to deliver messages you requested. You can export, edit, or permanently delete your data at any time — see our Privacy Policy for the process.
This is true even after you opt out. When you opt out, we stop sending — and we delete your phone number from our active routing within 30 days. We may retain minimal consent records (e.g. the timestamp of your opt-out) as required by law, but we never use them to contact you again.
11Availability
SMS delivery is provided on a best-effort basis. We aim for high reliability, but we cannot guarantee that any specific message will be delivered, that delivery will be instant, or that the service will be uninterrupted. SMS is a complement to in-app and email notifications — not a replacement. For critical alerts, we recommend keeping email or in-app notifications enabled as a backup.
We may suspend or terminate the SMS program at any time, with notice when reasonably possible.
12Age requirement
You must be at least 18 years old (or the age of majority in your jurisdiction) to opt in to receive SMS from Ktechhq. By opting in, you confirm that you meet this requirement.
13Changes to these terms
We may update these SMS Terms from time to time. When we do, we'll change the "Last updated" date above and, for material changes, give you advance notice (for example, by email or in-product banner). Continuing to use SMS after a change means you accept the updated terms.
14Limitation of liability
To the maximum extent permitted by law, Ktechhq is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the SMS program, including but not limited to failed or delayed delivery, unauthorized access to messages, or carrier charges. Our total liability for any claim related to SMS is limited to the amount you paid us (if any) for the SMS service in the 12 months preceding the claim.
Nothing in these terms is intended to override rights you have under applicable law (including the TCPA, CTIA guidelines, and state consumer protection laws).
