SMS Terms & Conditions
The rules of the road for receiving text messages from Ktechhq — conversational messages and alerts about your schedule and practice. Plain language, with the no-marketing promise and your data ownership front and center.
1. SMS from Ktechhq is for operational messages only — conversational messages and alerts, no marketing, ever. 2. Your phone number and message data belong to you. We don't sell, rent, or share them with third parties for marketing. You can delete them at any time.
01The program
The Ktechhq SMS program delivers two categories of messages to healthcare providers, sent on behalf of their medical group: conversational messages (two-way texts with your group's scheduling office) and alerts (reminders and notifications about your schedule and practice). Example messages include:
- "Reminder: it's your turn to choose call for the September schedule." (Alert)
- "It's your turn to pick vacation — your selection window closes Friday." (Alert)
- "Open shift: Tuesday 7a–3p. Reply if you'd like to take it." (Alert)
- "Schedule change: you're now on call this Saturday." (Alert)
- "Got it — we've moved you to the late room Thursday." (Conversational)
These are examples — the actual messages depend on the programs your medical group runs and which ones you enrolled in. You always see the source of every message in the message body itself.
02Not for marketing
No promotional content. No sales offers. No newsletters. No cross-sell of third-party products. No "we miss you" re-engagement campaigns. No upsells. No affiliate offers. No surveys for marketing purposes. SMS is reserved strictly for the operational messages you opted in to — conversational messages and alerts.
If we ever decide to add an optional marketing channel, it will require a separate, explicit opt-in from you. We will never convert your operational opt-in into a marketing opt-in automatically.
03Opt-in & consent
You opt in to receive SMS through one of the following actions — each of which constitutes your prior express consent under the Telephone Consumer Protection Act (TCPA):
- Giving verbal consent during an in-person or phone interaction with your medical group's scheduling office.
- Giving written consent on a form or in your group's scheduling portal, or replying YES to a confirmation text.
- Sending an email to opt-in@ktechhq.com explicitly requesting to receive SMS messages from Ktech — including your mobile phone number and your consent to receive conversational messages and alerts. (The SMS Opt-In Form submits this request for you.)
When you opt in, you confirm that:
- You are the owner or authorized user of the mobile number you provided.
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You understand that consent is not a condition of employment or of receiving any service from Ktechhq or your medical group.
You can opt out at any time — see Opting out. Replying STOP stops all Ktechhq SMS; to drop just one program (say, open-shift alerts) while keeping others, ask your scheduling office.
04Message frequency
Message frequency varies with your medical group's schedule cycle and the programs you're enrolled in. As a general guide:
- Call- and vacation-selection reminders — typically 1–4 messages per month, clustered around your group's selection windows.
- Open-shift and coverage alerts — varies with staffing needs; can be several per week during busy periods.
- Conversational messages — only when you and the scheduling office are actively messaging.
Your group controls what gets sent and when. If the volume isn't right for you, ask the scheduling office to adjust which programs you're enrolled in.
05Costs & rates
Message and data rates may apply for any SMS we send, depending on your mobile carrier and plan. Ktechhq does not charge you a fee for the SMS service itself, but your carrier's standard messaging rates still apply.
Check with your carrier for details on your specific plan. International rates may apply if you're traveling outside the U.S. when a message is delivered.
06Supported carriers
SMS delivery is supported on all major U.S. carriers, including but not limited to:
- AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Cricket, Metro by T-Mobile, Tracfone, Boost Mobile, Google Fi, and other T-Mobile/MVNOs.
- Most regional and pre-paid carriers operating on the major networks above.
Carriers are not liable for delayed or undelivered messages. Delivery is on a best-effort basis and depends on factors outside our control (network coverage, device state, etc.).
07Opting out
You can stop receiving SMS at any time, by any of these methods:
- Reply STOP to any message we send. You'll receive a one-time confirmation and no further messages.
- Tell your medical group's scheduling office — in person or in writing.
- Email info@ktechhq.com from any address — include the mobile number you want unsubscribed. No specific wording is required.
Note: STOP opts you out of all Ktechhq SMS, not just one program. To re-enable, opt in again — verbally, in writing, or via the SMS Opt-In Form.
08Help
Reply HELP to any message for help, or contact info@ktechhq.com. We respond to support requests during business hours (U.S. Eastern Time, Mon–Fri) and aim for same-day replies.
09Your data & privacy
When you opt in to SMS, we collect and store:
- Your phone number — to deliver the alerts you requested.
- The content of each message we send you — for delivery confirmation, debugging, and audit.
- Delivery status (delivered, failed, queued) — provided by your carrier, used to retry failed messages and improve reliability.
- Basic opt-in / opt-out events with timestamps — required by law to prove consent.
We do not collect, and do not want, any other personal information via SMS. We will never ask you for a password, payment info, or sensitive data over text. If you receive any such message claiming to be from us, treat it as fraudulent and report it.
Our full data practices — including how we share with the SMS delivery partner — are described in our Privacy Policy. Opt-in capture and revocation (verbal, written, and email) is described in our Communications Opt-In Policy.
10Data ownership
Ktechhq will not sell, rent, lease, loan, trade, or otherwise commercially exploit your phone number or the content of your messages. We share phone numbers only with the SMS delivery partner strictly to deliver messages you requested. You can export, edit, or permanently delete your data at any time — see our Privacy Policy for the process.
This is true even after you opt out. When you opt out, we stop sending — and we delete your phone number from our active routing within 30 days. We may retain minimal consent records (e.g. the timestamp of your opt-out) as required by law, but we never use them to contact you again.
11Availability
SMS delivery is provided on a best-effort basis. We aim for high reliability, but we cannot guarantee that any specific message will be delivered, that delivery will be instant, or that the service will be uninterrupted. SMS is a complement to your group's normal scheduling process — not the official record. For anything critical (like making your call or vacation selections on time), always confirm through your group's standard process.
We may suspend or terminate the SMS program at any time, with notice when reasonably possible.
12Age requirement
You must be at least 18 years old (or the age of majority in your jurisdiction) to opt in to receive SMS from Ktechhq. By opting in, you confirm that you meet this requirement.
13Changes to these terms
We may update these SMS Terms from time to time. When we do, we'll change the "Last updated" date above and, for material changes, give you advance notice (for example, by text message or through your medical group's scheduling office). Continuing to use SMS after a change means you accept the updated terms.
14Limitation of liability
To the maximum extent permitted by law, Ktechhq is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the SMS program, including but not limited to failed or delayed delivery, unauthorized access to messages, or carrier charges. Our total liability for any claim related to SMS is limited to the amount you paid us (if any) for the SMS service in the 12 months preceding the claim.
Nothing in these terms is intended to override rights you have under applicable law (including the TCPA, CTIA guidelines, and state consumer protection laws).
